By accessing or using homsy.ca (the "Site") you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Site.
Homsy is a real-estate search platform that helps you find properties, save searches, book showings, request a comparative market analysis (CMA) of your home, and connect with Alex Goodman and the brokerage. Using the Site does not by itself create an agency or client relationship; a representation relationship arises only under a separate written agreement.
You must be 18+ and able to form a binding contract. You are responsible for the accuracy of your registration information, for keeping your password confidential, and for activity under your account. Notify us immediately of any unauthorized use.
Property listing and sold data on the Site is provided under licence from the Toronto Regional Real Estate Board (TRREB) and the Canadian Real Estate Association (CREA) and is displayed through a Virtual Office Website ("VOW"). By registering and using this data you agree that:
The REALTOR®, REALTORS®, MLS®, and Multiple Listing Service® trademarks and associated logos are owned or controlled by CREA and used under licence.
Listing information is provided by third parties and is not guaranteed to be accurate, complete, or current. Listings may be sold, withdrawn, or changed without notice. You must independently verify all information (including price, taxes, measurements, status, and property details) and should not rely on the Site as the sole basis for any decision. The Site is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.
Any home-value estimate or comparative market analysis (CMA) provided through the Site is an informational opinion prepared from available market data. It is NOT a formal appraisal, a Letter of Opinion of Value for lending purposes, or a guarantee of sale price, and must not be relied on as one. Estimates and CMAs can differ materially from a property's actual market or sale value. For lending or legal purposes, engage a licensed appraiser.
You agree not to: use the Site unlawfully or for any unlawful purpose; infringe others' rights; upload malicious code; attempt to gain unauthorized access to the Site, accounts, or systems; interfere with the Site's operation; or use the Site to send spam or harvest others' information. We may investigate and take action, including reporting to authorities.
By registering you agree to receive transactional messages (e.g., verification codes, password resets, booking confirmations), sent using the contact method you chose. Marketing messages are sent only with your express consent and you may withdraw it at any time (see the Privacy Policy and the unsubscribe link in each marketing message).
Except for third-party listing data and trademarks, the Site's content, design, and software are owned by or licensed to Homsy and are protected by law. You receive a limited, revocable, non-exclusive licence to use the Site for its intended personal purpose. No other rights are granted.
The Site may link to or rely on third-party services (e.g., mapping and listing data). We are not responsible for third-party content, products, or practices; your use of them is at your own risk and subject to their terms.
To the fullest extent permitted by law, Homsy, Alex Goodman, and RE/MAX Your Community Realty, Brokerage are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of (or inability to use) the Site or reliance on its content.
You agree to indemnify and hold harmless Homsy, Alex Goodman, and the brokerage from claims arising out of your misuse of the Site or breach of these Terms.
We may suspend or terminate your access or account at any time, with or without notice, for any reason, including breach of these Terms, the VOW terms, or the acceptable-use rules, or for suspected fraudulent, abusive, or unlawful activity. You may close your account at any time by contacting info@homsy.ca. Provisions that by their nature should survive (e.g., data-use restrictions, disclaimers, limitation of liability) survive termination.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, and you submit to the exclusive jurisdiction of the courts of Ontario.
We may update these Terms; the "Last updated" date will change. Continued use after changes means you accept them.
